Rachel Rawson Photography – Terms and Conditions

These Terms and Conditions apply to all photography services provided by Rachel Rawson Photography. By booking photography services with Rachel Rawson Photography, you agree to the terms outlined below.
These Terms and Conditions are governed by the laws of England and Wales.
1. Definitions

“Photographer” refers to Rachel Rawson Photography.

“Client” refers to the individual or organisation booking photography services.

“Services” refers to any photography session, event coverage, editing, image delivery, or related services provided.
2. Booking and Payment
2.1 Booking Confirmation
Bookings are only confirmed once:
-
A booking fee or deposit has been paid (where applicable), and
-
Written confirmation has been provided by Rachel Rawson Photography.
The Photographer reserves the right to decline bookings at their discretion.
2.2 Deposits and Booking Fees
A non-refundable deposit or booking fee may be required to secure the booking date and time.
The remaining balance must be paid within the agreed payment terms stated on the invoice or booking confirmation.
2.3 Late Payments
Rachel Rawson Photography reserves the right to withhold delivery of images until full payment has been received.
Late payments may incur additional charges where permitted under applicable UK law.
3. Cancellations and Rescheduling
3.1 Client Cancellation
If the Client wishes to cancel a booking:

Deposits and booking fees are non-refundable.

Cancellations made within 14 days of the scheduled session may require full payment.

Wedding and event bookings cancelled within 30 days of the event may remain fully chargeable due to preparation and reserved availability.
3.2 Rescheduling
Requests to reschedule are subject to availability.
Rachel Rawson Photography will make reasonable efforts to accommodate alternative dates where possible.
4. Photographer Cancellation
In the unlikely event that Rachel Rawson Photography is unable to fulfil the booking due to illness, emergency, severe weather, or circumstances beyond reasonable control:

An alternative date may be offered where possible, or
-
A full refund of monies paid will be provided.
Liability shall be limited to the total amount paid by the Client for the affected services.
5. Delivery of Images
5.1 Editing Style
Clients acknowledge that they are familiar with the Photographer’s portfolio and editing style.
Final images are delivered at the Photographer’s artistic discretion.
RAW or unedited files are not normally supplied unless agreed in writing.
5.2 Delivery Times
Estimated delivery times will be communicated to the Client; however, these may vary depending on workload, seasonal demand, or unforeseen circumstances.
5.3 Image Storage
Rachel Rawson Photography will make reasonable efforts to retain copies of final edited images for a limited period; however, long-term storage is not guaranteed.
Clients are responsible for downloading and securely backing up their images upon delivery.
6. Copyright and Image Usage
Under the Copyright, Designs and Patents Act 1988, copyright in all images remains the property of Rachel Rawson Photography unless otherwise agreed in writing.
6.1 Client Usage
Clients are granted a personal, non-exclusive licence to use delivered images for personal use, including:

Printing
-
Sharing with family and friends
-
Posting on personal social media accounts
Images must not be altered, filtered, edited, sold, or used commercially without prior written permission.
6.2 Commercial Usage
Commercial usage rights, publication rights, or licensing arrangements must be agreed separately in writing.
7. Website and Portfolio Use
Rachel Rawson Photography may use selected images for:

Portfolio purposes
-
Website galleries
-
Social media
-
Marketing and promotional materials
Clients who do not wish for images to be used publicly should notify the Photographer in writing before the photography session or event.
8. Client Responsibilities
The Client agrees to:

Provide accurate booking information

Obtain permission for photography at venues where required

Ensure cooperation from participants during sessions
-
Arrive on time for scheduled sessions
Rachel Rawson Photography cannot be held responsible for missed images caused by lateness, venue restrictions, weather conditions, or lack of cooperation from participants.
9. Limitation of Liability
While every reasonable effort is made to provide high-quality photography services, Rachel Rawson Photography shall not be liable for:

Indirect or consequential losses

Technical failures beyond reasonable control

Loss or damage caused by events outside reasonable control

Dissatisfaction arising from subjective artistic preference
Nothing in these Terms excludes liability where exclusion is unlawful under UK law.
10. Data Protection and Privacy
Personal information provided by Clients will be processed in accordance with the Rachel Rawson Photography Privacy Policy and applicable UK GDPR legislation.
11. Consumer Rights
Nothing within these Terms and Conditions affects the Client’s statutory rights under applicable UK consumer protection legislation, including the Consumer Rights Act 2015.
12. Governing Law
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of England and Wales.
Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
